3. User Accounts and Registration

4. Usage Guidelines and Restrictions

4.1 Acceptable Use

You agree to use Tesla Mind only for lawful purposes and in accordance with these Terms. You may:

• Create and manage your ideas and thoughts
• Engage in productive conversations with the AI system

4.2 Prohibited Activities

You agree NOT to:

• Attempt to reverse engineer, decompile, or hack the App
• Share harmful, abusive, or inappropriate content
• Violate any applicable laws or regulations
• Interfere with or disrupt the App's functionality
• Use the App to generate spam or malicious content
• Attempt to circumvent usage limits or security measures
• Share your account credentials with others

5. Usage Limits

• Daily Token Limit: 50,000 tokens per day to encourage mindful usage
• Reset Schedule: Limits reset daily at midnight local time
• Fair Use: We reserve the right to implement additional reasonable usage limits

6. Intellectual Property Rights

• App Content: Tesla Mind and its features are protected by intellectual property laws
• Your Content: You retain rights to your ideas, messages, and content created in the App
• License to Use: You grant us a limited license to process your content to provide our services
• Trademarks: Tesla Mind and related marks are our trademarks

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. AI and Content Disclaimer

• AI responses are generated automatically and may not always be accurate
• The App is for informational and cognitive enhancement purposes only
• AI responses should not be considered as professional advice
• You should verify important information independently
• We are not responsible for decisions made based on AI responses

9. Service Availability

• We strive to maintain high service availability but cannot guarantee uninterrupted access
• The App may be temporarily unavailable for maintenance or updates
• We reserve the right to modify or discontinue features with notice

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Tesla Mind is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the App (if any)
• We are not responsible for third-party services or content

11. Subscription, Cancellation, and Refund Policy

• Subscription Plans: Tesla Mind offers optional paid subscription plans that provide enhanced features and higher daily token limits.
• Billing: Subscriptions are billed monthly through the Apple App Store or Google Play Store, depending on your device.
• Cancellation: You may cancel your subscription at any time via your app store account settings. Your premium access will remain active until the end of the current billing period.
• Refunds: Refunds for subscriptions are handled according to the policies of the Apple App Store or Google Play Store. Please contact the respective store for refund requests.
• Changes to Subscription: We reserve the right to modify subscription features or pricing with advance notice. Any changes will be communicated in-app and/or via email.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

13. Termination

• By You: You may terminate your account at any time
• By Us: We may suspend or terminate accounts for violations of these Terms
• Effect: Upon termination, your right to use the App ceases immediately
